On December 11, 2023, U.S. President Joseph Biden issued Proclamation 10685, Suspension of Entry as Immigrants and Nonimmigrants of Persons Enabling Corruption (“Proclamation”). The Proclamation, which also includes immediate family members is intended to prevent individuals who engage in significant corruption from accessing the United States.
The Proclamation, which is effectively immediately, covers the following individuals:
- Persons who have enabled, facilitated, or otherwise been involved in significant corruption, including through money laundering, judicial or investigation obstruction;
- The immediate family members of those who engage in such significant corruption.
Exceptions to the Proclamation include individuals who are currently lawful permanent residents, and those who have already been granted asylum or admitted to the United States as a refugee. The Proclamation also delegates authority to the Secretary of State to those who are covered by the Proclamation be allowed entry if it is determined that their entry would not be contrary to national security interests.
