$800,000 for projects in a Targeted Employment Area (TEA), which includes rural areas, high-unemployment areas and qualifying infrastructure projects; or $1,050,000 for standard projects not in a TEA. Most Regional Center projects are structured to qualify at the lower TEA threshold. These amounts are scheduled for inflation adjustment beginning January 1, 2027.
Rural projects (which receive priority processing) typically take 6 to 12 months for I-526E approval. Standard urban projects typically take 18 to 36 months. After approval, the investor attends a consular interview at the U.S. Consulate in Ho Chi Minh City or the U.S. Embassy in Manila and enters the United States with a 2-year conditional green card. Total time to a permanent 10-year green card is typically 3 to 6 years.
Yes – this is the most common approach for Vietnamese and Filipino investors. Rather than directly managing a business, the investor contributes capital to a USCIS-approved Regional Center project. The investor takes a passive role while the Regional Center manages the day-to-day operations. The EB-5 Reform and Integrity Act of 2022 (RIA) reauthorized the Regional Center Program and added significant new investor protections, including enhanced project oversight, transparency requirements, and the grandfathering provision under Section 108 that protects investors who file before the program’s authorization deadline. Your spouse and eligible unmarried children under 21 may apply as derivative beneficiaries. Each family member must satisfy the applicable visa or adjustment-of-status requirements. Child Status Protection Act rules may affect a child’s immigration age; review age-out risks before filing. Petition approval does not automatically issue green cards to the family.
Evidence depends on how your capital was earned or acquired. It may include tax returns, employment or business income records, bank statements, property sale records, gift or inheritance documents, and records tracing transfers into the investment. Gifts and loans require review of their lawful source and applicable requirements. An attorney should identify missing records and prepare a source-and-path-of-funds explanation for your circumstances.
A Regional Center is a USCIS-approved organization that pools EB-5 capital and directs it into qualifying commercial projects in the United States. The key advantage: both direct and indirect jobs count toward the 10-job requirement, making compliance significantly easier than a direct investment. Under RIA 2022, Regional Centers are subject to enhanced integrity rules and annual reporting obligations designed to protect investors.
