EB-5 Investors Face Significant USCIS Filing Fee Increases

Prospective EB-5 investors should consider filing before November 30, 2026, to avoid substantial increases in United States Citizenship and Immigration Services (“USCIS”) filing fees.

The USCIS is implementing significant fee increases that will affect EB-5 investors, regional centers, and EB-5 investment projects. For EB-5 investors who are ready and eligible to file a Form I-526E, Immigrant Petition by Regional Center Investor (“Form I-526E”) before the new fees take effect.

Form I-526E Filing Fees Will More Than Double

The USCIS filing fee for an initial Form I-526E     is scheduled to increase from US$3,675 to US$7,850.  This represents an increase of US$4,175, or approximately one-hundred and fourteen percent (114%.)

The separate EB-5 Integrity Fund fee which is required to be paid by an EB-5 investor filing Form I-526E will increase from $1,000 to $1,100.

As a result, the total USCIS fees payable by an EB-5 investor when filing Form I-526E will increase to US$4275, summarized as follows:

 Current FeeNew FeeIncrease
Form I-526E$3,675$7,850$4,175
EB-5 Integrity Fund Fee$1,000$1,100$100
Total$4,675$8,950$4,275
Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status (“Form I-829”) Fee Will Also Increase

The fee increase also affects EB-5 investors who have already obtained conditional permanent resident status through the EB-5 program.

The USCIS filing fee for Form I-829     will increase US$1250 from US$3,750 to US$5,000.

Significant Increases for Regional Centers and EB-5 Projects

The new USCIS fee rule will also substantially increase certain fees paid by EB-5 regional centers and individual EB-5 investment projects.  These additional costs may ultimately affect the overall expenses associated with establishing and operating EB-5 projects and regional centers.  However, some forms and services provided by USCIS will see a reduction in the fees.

What Prospective EB-5 Investors Should Consider

The increased filing fees make the timing of an EB-5 investment more important for EB-5 investors who are already prepared to proceed.

If you are considering an EB-5 investment and have identified a suitable project, you should evaluate whether you can complete the required investment and documentation in order to file your Form I-526E before      November 30, 2026.

However, EB-5 investors should not rush into an EB-5 investment solely to avoid a fee increase. The investment must satisfy all applicable EB-5 requirements, and the project should be carefully evaluated for both immigration eligibility and investment risk.

What Are the Financial Requirements to Sponsor a Spouse from Vietnam or the Philippines?

When you sponsor your husband or wife for a U.S. immigrant visa, the government wants to see that there will be adequate financial support once your spouse becomes a lawful permanent resident (“Green Card Holder.”). Unfortunately, the rules can become more complicated when you live in Vietnam or the Philippines, earn income abroad, recently returned to the United States or cannot show that you have earned enough income on your tax transcripts. Understanding the Form I-864 income requirements to sponsor a spouse from Vietnam or the Philippines can help you identify those issues before they slow down your case. EB-5 Capital Redeployment Under The RIA

For EB-5 investors, capital redeployment is an important consideration when investment funds are repaid by the original job-creating entity to the New Commercial Enterprise (“NCE”). The Reform and Integrity Act (“RIA”) establishes specific parameters governing when a NCE must redeploy investment funds while continuing to maintain the EB-5 investors’ capital at risk. Under the RIA, the Secretary of Homeland Security is directed to prescribe regulations that allow an NCE to redeploy investment funds anywhere within the United States or its territories for the purpose of maintaining EB-5 investors’ capital at risk, provided that certain requirements are satisfied. Requirements for Capital Redeployment The RIA identifies four key conditions that must be met for the redeployment of investment funds. 1.
