What Is The EB-5 Reform And Integrity Act of 2022?

The EB-5 Reform and Integrity Act of 2022 (“RIA”) made significant changes to the U.S. EB-5 Immigrant Investor Program. This program enables international investors and their immediate family members to apply for U.S. Permanent Residency and obtain “green cards” by making a significant investment in a U.S. company and creating jobs for U.S. workers.

The primary features of the RIA include:

  1. The EB-5 Regional Center Program has been reauthorized and improved for better stability;
  2. An increase in the program’s minimum investment requirements;
  3. Changes to the criterion for Targeted Employment Areas;
  4. Strengthened integrity procedures to improve the program’s transparency and security;
  5. The creation of new Reserved Visa categories;
  6. Investors in the program will benefit from enhanced protections;

New Visa Waiver Program ESTA Fees Authorized by the Reconciliation Bill

On July 4, 2025, U.S. President Trump signed into law a Reconciliation Bill passed by both houses of Congress.  Among many U.S. immigration-related provisions, the Bill includes new fees for various immigration-related applications.  In most cases, these fees are in addition to existing fees.   The fees listed are minimum fees that could increase by regulation and annually for inflation. In most instances, the fees are not waivable. Fees will take effect immediately under the statute; however, there may be delays in collection as the government operationalizes payment. For Taiwan Nationals, the most impact will be seen in an increase to the ESTA Fee for the Visa Waiver Program.  Applicants applying online for their ESTA approval will need to pay US$40 for their application.  It is uncertain when this fee will go into effect. For individuals seeking lawful permanent residency while remaining in the United States, the Adjustment of Status (AOS) process offers a pathway to obtain a Green Card without leaving the country. In family-based immigration scenarios, a pivotal element of this process is the Form I-864, Affidavit of Support (“Form I-864”). This document creates a legal obligation between the Sponsor and the U.S. The Sponsor agrees to provide financial support to the immigrant (“Beneficiary”), ensuring they will not become reliant on government assistance.
