David Enterline and Ryan Barshop recently presented at an EB-5 seminar with AIMS Relocation and Immigration Specialist at the company’s Manila, Philippines office. AIMS, a Singapore-headquartered company is dedicated to supporting individuals and companies for all of their migration and relocation needs. Founded in Singapore in November 2006, AIMS currently has 14 offices across Asia- Pacific with the Manila office as its most recent.

Mr. Enterline and Mr. Barshop’s presentation was organized for Filipino individuals interested in applying for an EB-5 immigrant investor visa. Applicants who submit their petitions prior to November 21 require a minimum investment of US$500,000 whereas applicants who file after November 21 will require a minimum investment of US$900,000. The seminar was well received by the attendees who expressed strong interest in immigrating to the United States under the EB-5 immigrant investor program.

Increased Investment Amounts Of The RIA

The Increased Investment Amounts section of the EB-5 Reform and Integrity Act of 2022 (“RIA”) raises the minimum investment thresholds to adjust for inflation and ensure the continued effectiveness of the program in promoting economic growth and job creation in the United States. Under the updated rules, the standard investment amount required for the EB-5 program has increased from $1 million to $1.05 million. For investments in Targeted Employment Areas (TEAs), which include rural areas or those with high unemployment, the minimum investment rises from $500,000 to $800,000. The original investment amounts had not been increased since the EB-5 program was created in 1990. These changes are intended to maintain the program’s ability to generate substantial capital for U.S. businesses and encourage investment in areas that need economic development. The United States Department of State (“DOS”) is now requiring immigrant visa applicants to apply for immigrant visas in the consular district designated for their place of residence or in their country of nationality. Effective immediately, if an immigrant visa applicant would like to transfer his or her pending immigrant visa case to a new consular district after the National Visa Center (“NVC”) has scheduled an interview appointment, the applicant should contact the NVC directly through the public inquiry form and not the Embassy or Consulate. In addition, if an immigrant visa applicant requests to be interviewed at an Embassy or Consulate outside their country of nationality, the NVC may request additional information to confirm that the location is the applicant’s place of residence or to confirm if an exception may be warranted.
