Enterline and Partners Successfully Obtains I-601 Waiver of Inadmissibility for Fraud/ Misrepresentation

Enterline and Partners recently obtained an I-601 Waiver of Inadmissibility for a client who was refused an immigrant visa. The client, who is married to a U.S. citizen, was previously charged with fraud/misrepresentation and sought our legal assistance in order to be reunited with her family.

The I-601 Waiver of Inadmissibility process took a little under 1 year and was heavily documented to show that the client’s U.S. citizen spouse would suffer extreme hardship if the client would be prevented from immigrating to the United States. Following approval, the client will now be eligible for a new immigrant visa interview allowing her to depart to the United States.

Age Determination For Children Of Alien Investors

Section 203(h) of the Immigration and Nationality Act (8 U.S.C. 1153(h)) was amended by the EB-5 Reform and Integrity Act of 2022 (“RIA”) to clarify how in some instances the age of children of investors is determined during participation in the EB-5 program. Under the RIA and the amendment to Section 203(h)(5), an investor’s “child” who has reached 21 years of age and was admitted as a Conditional Permanent Resident as the child of an investor lawfully admitted for permanent residence under subsection (b)(5) will continue to be considered a child of the principal petitioner.
