The United States Department of State (“DOS”) has extended DOS consular officers’ authority to waive in-person interviews for certain nonimmigrant visa categories through December 31, 2023.
The announcement made on December 23, 2022 replaces the previous policy extending nonimmigrant visa waivers through December 31, 2022 and allows DOS consular officers to continue to waive in-person interviews for both renewing and first-time applicants on a case-to-case basis for the following nonimmigrant visa categories:
- B-1/ B-2 Visitor Visas;
- H-2 Temporary Agricultural and Non-Agricultural Visas;
- F and M Student Visas;
- J Academic Exchange Visas;
- H-1B Specialty Occupation Visas;
- H-3 Trainee or Special Education Visas;
- L Intracompany Transferee Visas;
- O Extraordinary Ability Visas;
- P Entertainer Visas; and
- Q International Cultural Exchange Visas.
As a result of DOS’s continued in-person waiver policy, nearly half of almost seven million nonimmigrant visas issued by DOS in Fiscal Year 2022 were adjudicated without an in-person interview.
