Enterline and Partners Successfully Expedites Form I-130 Petition with Direct Consular Filing at the U.S. Embassy in Manila

Enterline and Partners is pleased to announce that our attorneys have successfully represented their clients through Direct Consular Filing (“DCF”) of a Form I-130 Petition for Alien Relative (“I-130 Petition) at the U.S. Embassy in Manila (“Embassy’).

Our clients, a U.S. citizen and a Philippines citizen, were seeking an alternative to the long waiting periods for an I-130 Petition filed directly with the United States Citizenship and Immigration Services (“USCIS”) due to the U.S citizen’s urgent need to relocate to the United States for work-related reasons. 

Following a consultation session in which we advised the couple that, while possible, DCF remains highly discretionary due to policy changes prior to the COVID-19 pandemic. After being properly advised of the benefits as well as the risks, the couple decided to engage our services.

Following the preparation of our detailed request outlining the specific reasons why our clients DCF request should be approved, thereby bypassing submitting an I-130 Petition to USCIS, our request was approved allowing our clients to file their I-130 Petition directly with the Embassy’s Immigrant Visa Unit. Timing from when our DCF request was submitted to the I-130 Petition approval took approximately 1 month as opposed to 10 to 14 months for I-130 Petitions processed with the  USCIS.

USCIS Now Requires Certain Adjustment Of Status Applicants To Submit Medical Examination With Their Form I-485 Application

Effectively immediately, the United States Citizenship and Immigration Services (“USCIS”) will require certain applicants filing a Form I-485, Application to Register Permanent Residence or Adjust Status to submit a Form I-693, Report of Immigration Medical Examination and Vaccination Record with their Form I-485 Application. Incoming Trump Administration Looks to Deport Migrants to Third-Party Countries

The incoming Trump administration is preparing a list of countries to which it may deport migrants if their home countries refuse to accept them, according to sources. These countries include Turks and Caicos, the Bahamas, Panama and Grenada.
