USCIS Flexibility For Responding to Agency Requests Will Expire on March 23, 2023

The United States Citizenship and Immigration Services (“USCIS”) COVID-19 related flexibilities will expire on March 23, 2023. The USCIS, which has extended COVID-19 related flexibilities multiple times including March 2022, October 2022 and January 2023 are not expected to be further extended.

The extensions have been in place to assist applicants, petitioners and requestors with additional time (60 days) in responding to certain USCIS requests including the following:

  • Requests for Evidence;
  • Continuous Requests for Evidence (N-14);
  • Notices of Intent to Deny;
  • Notices of Intent to Revoke;
  • Notices of Intent to Rescind;
  • Notices of Intent to Terminate Regional Centers;
  • Notices of Intent to Withdraw Temporary Protected Status; and
  • Motions to Reopen an N-400 Pursuant to 8 CFR 335.5, Receipt of Derogatory Information After Grant.

The extensions also allowed to consider a Form I-290B, Notice of Appeal or Motion or a Form-336, Request for Hearing on a Decision in Naturalization Proceedings (Under Section 336 of the INA) if:

  • The form was filed up to 90 days from the date the decision was made; and
  • The decision was made between November 21, 2021 and March 23, 2023.

DOS to Suspend Immigrant Visa Applications from Seventy-Five Countries. Philippines and Vietnam Not Included in the Suspension

The United States Department of State (“DOS”) has announced that it will freeze immigrant visa processing for seventy-five (75) countries citing concerns that citizens from those countries might become a public charge and require government financial assistance upon entering the United States. The directive instructs DOS consular officers to pause immigrant visa applications under existing laws. It does not affect nonimmigrant visa applications including B-1/B-2 Visitor Visas, L-1 Intracompany Transfer Visas, F and J Student Visas, and E-1/E-2 Treaty Trader and Investor Visas.
