Reauthorization and Stability From The RIA

The Reauthorization and Stability section of the EB-5 Reform and Integrity Act of 2022 (“RIA”) focuses on the continuation and enhancement of the EB-5 Regional Center Program, which had previously lapsed in 2021. The Regional Center Program is a part of the EB-5 Immigrant Investor Program passed by the U.S. Congress in 1990. It allows foreign investors to qualify for U.S. permanent residency by making qualifying investments in designated regional centers sponsored businesses and projects that create jobs for U.S. workers.

The Regional Center Program had always been a “pilot” or temporary program. The reauthorization extended the Regional Center Program for five years, providing stability and predictability for both investors and businesses participating in the program. In addition, the Act introduces new safeguards to enhance oversight and ensure compliance with federal regulations. This includes stricter requirements for Regional Centers, such as increased transparency through regular reporting, regular audits, and improved tracking of investments and job creation. The RIA also mandates the creation of a database to monitor Regional Center compliance and the performance of EB-5 projects.

These measures are designed to restore confidence in the program, prevent fraud, and maintain the program integrity, which is essential for attracting future foreign investment to support U.S. job growth and economic development.

DOS Suspension of Immigrant Visa Processing

On August 21, 2026, the United States Department of State (“DOS”) suspended many immigrant visa processing at Embassies and Consulates worldwide. As a result of the pause, many immigrant visa applicants (including K-1 fiancé visa applicants) have had their interviews cancelled. Immigrant visa applicants whose cases are currently undergoing processing, including those who were subject to 221(g) administrative review, have also had their cases placed on while DOS is providing additional training to consular officers concerning public charge inadmissibility. Although the suspension is temporary, DOS has not announced a specific date of when immigrant visa interviews and processing will resume. In addition, the suspension is impacting only applicants who are consular processing at the respective Embassy or Consulate. Immigrant visa applicants whose cases are still pending or processing with the United States Citizenship and Immigration Service or the National Visa Center are not affected by the current situation. DOS Releases Fact Sheet On Establishing Birth Tourism Prevention Task Force

The United States Department of State (“DOS”) has released a fact sheet on establishing a new Birth Tourism Prevention Task Force (“Task Force”) that reviews nonimmigrant visa holders activities specifically to identify those who have engaged in birth tourism and to revoke visas for those who engage or facilitate in the practice. The Task Force, which is being overseen by DOS Secretary Marco Rubio, will have a number of functions including the following: According to the Task Force, birth tourism has become a for-profit industry with facilitators marketing the practice as doulas, midwives, or wellness advocates while advertising “birth in the U.S.” services complete with visa coaching and medical arrangements. The Task Force further notes that some facilitators have gone as far as forging medical records, coaching clients to conceal their true travel purposes, and avoid paying hospital bills complete with online marketing promises of “automatic citizenship” for their child

Regional Center Amendments and Record Keeping

Regional Centers participating in the EB-5 Immigrant Investor program are subject to ongoing compliance requirements designed to maintain transparency and accountability. These requirements include notifying the Department of Homeland Security (“DHS”) of significant organizational changes, maintaining records for a specified period, and cooperating with government audits. Understanding these obligations is important for Regional Centers as they continue to operate and support EB-5 investment projects. Notification Requirements for Significant Changes A Regional Center is required to notify the U.S. Citizenship and Immigration Services (“USCIS”) of significant proposed changes to its organizational structure, ownership, or administration. This includes the sale of the Regional Center, as well as other arrangements that would result in individuals who were not previously subject to the requirements under subparagraph (H) (INA§203(b)(5)(H)) becoming involved with the Regional Center.
