Enterline and Partners to Speak at Regional Conference

Ryan Barshop and David Enterline of Enterline and Partners will speak at the American Immigration Lawyers Association (“AILA”), Bangkok District Chapter (“BDC”), “8^th Annual Consular Processing Conference” in Taipei, Taiwan. AILA is an international organization of more than 15,000 attorneys and law professors who practice and teach immigration law.

Ryan will speak on the panel “APAC Consular Tips from the “Boots on the Ground” (Part I)”, A practical discussion by in-country attorneys giving invaluable advice on the trends, tips and unique processes when dealing with consulates in Japan, Philippines, Thailand, India and Vietnam.

David will serve as the Discussion Leader of the conference “EB-5 Panel” and also speak on the panel “Visa Processing at American Institute in Taiwan” which will of course focus on advice on the trends, tips and unique processes when dealing with visa matters at the American Institute in Taiwan (“AIT”). Both panels will also have consular officers from AIT joining in the panel discussions.

David and Ryan are frequent speakers at AILA regional conferences having presented at past conferences in Manila, Ho Chi Minh City, Bangkok Chennai, and Hong Kong as well as AILA National Conferences in the United States.

Age Determination For Children Of Alien Investors

Section 203(h) of the Immigration and Nationality Act (8 U.S.C. 1153(h)) was amended by the EB-5 Reform and Integrity Act of 2022 (“RIA”) to clarify how in some instances the age of children of investors is determined during participation in the EB-5 program. Under the RIA and the amendment to Section 203(h)(5), an investor’s “child” who has reached 21 years of age and was admitted as a Conditional Permanent Resident as the child of an investor lawfully admitted for permanent residence under subsection (b)(5) will continue to be considered a child of the principal petitioner. Most importantly, this continued classification as a “child” is maintained for any subsequent EB-5 Form I-526 Petition, provided specific conditions are met.
