AILA – Quy Trình Miễn Visa Không Định Cư

Những cá nhân được yêu cầu phải xin thị thực để nhập cảnh Hoa Kỳ cần phải nộp đơn tại lãnh sự quán Hoa Kỳ ở nước ngoài. Một phần quan trọng của quy trình nộp đơn là phỏng vấn trực tiếp tại lãnh sự quán để xác minh thông tin trong đơn và đặt câu hỏi về tính đủ điều kiện để được cấp thị thực. Nếu đơn xin thị thực được chấp thuận, lãnh sự quán sẽ cấp thị thực vào hộ chiếu của đương đơn và sắp xếp việc trả lại hộ chiếu cùng thị thực cho họ.

Trong những năm gần đây, nhiều cơ quan lãnh sự đã thực hiện thủ tục miễn phỏng vấn cho phép một số đương đơn xin thị thực không định cư có được thị thực mà không cần phỏng vấn trực tiếp. Do đại dịch COVID-19, quy trình miễn phỏng vấn này đã được thực hiện rộng rãi hơn tại các cơ quan lãnh sự trên toàn thế giới và những yêu cầu để đủ điều kiện đã được mở rộng. Sử dụng quy trình này là một lựa chọn thuận tiện cho những người gia hạn thị thực trong cùng một diện không định cư và có thể giảm bớt sự phức tạp và lo lắng của cuộc phỏng vấn trực tiếp với nhân viên lãnh sự.

Vì thủ tục áp dụng ở mỗi địa phương có thể khác nhau, đương đơn nên xem lại trang web của lãnh sự quán nơi mình đang cư trú để xác định xem thủ tục miễn phỏng vấn đã được áp dụng hay chưa. Trong một số trường hợp, đương đơn cũng có thể cần tham khảo trang web đặt lịch hẹn. Lưu ý: Lãnh sự quán có quyền yêu cầu phỏng vấn bất kỳ đương đơn nào mà họ đã nhận được đơn xin thị thực.

Nếu một lãnh sự quán áp dụng quy trình miễn phỏng vấn và đương đơn xin thị thực hội đủ điều kiện, đương đơn phải lên lịch gửi tài liệu trực tiếp hoặc gửi bưu điện tới lãnh sự quán đó. Thông thường, những giấy tờ này bao gồm: Trang xác nhận DS-160, hộ chiếu hợp lệ, phí chuyển phát nhanh trả trước cho việc nhận lại hộ chiếu/tài liệu, biên lai phí MRV, hai ảnh kiểu hộ chiếu và thông báo phê duyệt đơn xin thị thực (chẳng hạn như Giấy Báo Nhận I-797)

Trong khi Bộ Ngoại giao Hoa Kỳ nỗ lực để giảm bớt số lượng hồ sơ xin thị thực không định cư còn tồn đọng chưa từng có, thì quy trình miễn phỏng vấn là một lựa chọn cần thiết cho những đương đơn đủ điều kiện muốn nhập cảnh vào Hoa Kỳ.

Tôi có đủ điều kiện để được miễn phỏng vấn?

Theo các yêu cầu về những điều kiện được mở rộng gần đây để được miễn phỏng vấn (có hiệu lực đến ngày 31 tháng 12 năm 2021), những đương đơn xin thị thực đáp ứng được các tiêu chí sau có thể đủ điều kiện tham gia chương trình miễn phỏng vấn:

• Đương đơn xin thị thực cùng loại với thị thực Hoa Kỳ mà họ đã được cấp trước đây;
• Đương đơn đang nộp đơn tại cơ quan lãnh sự nơi họ thường trú;
• Thị thực trước không được chú thích là “Clearance Received” hoặc “Department Authorization”;
• Thị thực gần đây nhất trong cùng phân loại mà đương đơn đăng ký, được cấp vào hoặc sau sinh nhật lần thứ 14 của họ (Trẻ em dưới 14 tuổi hiếm khi được yêu cầu phỏng vấn.);
• Thị thực gần đây nhất trong cùng phân loại mà đương đơn đăng ký không bị mất/bị đánh cắp hoặc bị hủy bỏ;
• Đương đơn trước đây không bị từ chối cấp thị thực trong bất kỳ phân loại nào, trừ khi việc từ chối đã được khắc phục hoặc cơ sở cho việc không chấp nhận đã được miễn; và
• Thị thực trước đây của đương đơn trong cùng phân loại vẫn còn hiệu lực hoặc đã hết hạn trong vòng 48 tháng qua.
