Enterline and Partners co-founder and immigration lawyer David Enterline recently spoke at the Investment Immigration Summit in Ho Chi Minh City, Vietnam. David was a speaker on the panel session entitled “Alternative residency and investment pathways to the U.S. – beyond EB-5”. The focus of the discussion was alternatives pathways that are available to investors who want to invest and live in the U.S. besides EB-5, or in conjunction with an EB-5 investment. This is the fifth Investment Immigration Summit that David has spoken at. He has also spoken at these events in Hong Kong and Mumbai, India. He will also be speaking at the Investment Immigration Summit in Singapore in June.

The Reauthorization and Stability section of the EB-5 Reform and Integrity Act of 2022 (“RIA”) focuses on the continuation and enhancement of the EB-5 Regional Center Program, which had previously lapsed in 2021. The Regional Center Program is a part of the EB-5 Immigrant Investor Program passed by the U.S. Congress in 1990. It allows foreign investors to qualify for U.S. permanent residency by making qualifying investments in designated regional centers sponsored businesses and projects that create jobs for U.S. workers. The Regional Center Program had always been a “pilot” or temporary program. The reauthorization extended the Regional Center Program for five years, providing stability and predictability for both investors and businesses participating in the program. In addition, the Act introduces new safeguards to enhance oversight and ensure compliance with federal regulations. This includes stricter requirements for Regional Centers, such as increased transparency through regular reporting, regular audits, and improved

Can the Intending Immigrant Help the Sponsor Meet the Income Requirements?

In family-based immigration cases, a central component of this process is the Form I-864, Affidavit of Support (“I-864”). This legally binding contract is required to demonstrate that the intending immigrant (the “Beneficiary”) has adequate financial support from the sponsoring family member (the “Sponsor”) through income and/or assets, and therefore the Beneficiary is unlikely to become a public charge (rely on government welfare for support). Through the completion of Form I-864, the Sponsor assumes substantial financial obligations enforceable under U.S. law. If the Sponsor does not have enough income or assets, under certain conditions, the Beneficiary’s income or assets may be used to help meet the Sponsor’s financial requirement. If the Beneficiary is the Sponsor’s spouse, their income may be counted if it will continue from the same source after obtaining lawful permanent resident status.
