The United States Citizenship and Immigration Services (“USCIS”) new filing fees have taken effect for all files received on or after April 1, 2024.
In addition to new filing fees, USCIS has also released new forms for certain petitions. While the new form edition dates begin on April 1, 2024, USCIS will accept the old form editions for some forms through June 3, 2024 provided that the correct filing fee is submitted. These forms apply to the following categories:
- Form I-129, Petition for a Nonimmigrant Worker
- Form I-129CW, Petition for a CNMI-Only Nonimmigrant Transitional Worker
- Form I-140, Immigrant Petition for Alien Workers
- Form I-600A, Application for Advance Processing of an Orphan Petition
- Form I-600, Petition to Classify Orphan and Immediate Relative
Along with across the board fee changes, most of which resulted in an increase to the fee, there is an important difference between the previous filing fees and the new filing fee to the Form I-485 Application to Register Permanent Residence or Adjust Status (“AOS”). Previously, AOS applicant’s filing fee of US$1225, or US$750 for minor dependent children, could include a Form I-131, Application for Travel Document and a Form I-765, Application for Employment Authorization for no additional fee. Now, new AOS applications are subject to an increased Form I-485 filing fee of US$1440, or US$950 for minor dependent children, and AOS applicants will also be required to pay separate fees for a Form I-131 and Form I-765.
