Announcement: USCIS Filing Fee Changes to Become Effective on October 2, 2020

The United States Citizenship and Immigration Services (“USCIS”) has posted for public inspection an advanced copy of a final rule that will significantly alter many fees the USCIS charges for services, including adding new fees, establishing multiple fees for nonimmigrant worker petitions, and limiting the number of beneficiaries for certain forms. Across all services, fees will increase by an average of 20 percent.

The rule also removes certain fee exemptions, changes fee waiver requirements, alters premium processing time limits, and modifies certain intercountry adoption processing. The USCIS advises the rule has been published in the Federal Register on August 3, 2020, and will be effective 60 days from the date of publication (October 2, 2020).

The fee revisions affect almost all immigration benefits including family-based immigrant and naturalization petitions and employment-based petitions.

Federal Court of Appeals Rules Against Trump’s EO Ending Birthright Citizenship

A Federal Court of Appeals handed the Trump Administration another blow in its fight to redefine the 14th Amendment ending birthright citizenship through Executive Order (“EO”). The San Francisco-based Ninth Circuit Court of Appeals rejected the Administration’s request for an emergency order putting on hold a nationwide ban issued by Seattle-based Judge John Coughenour last month who found the EO blatantly unconstitutional. Judge Coughenour decision was swiftly followed by Judge Deborah Boardman’s decision in Maryland who also ruled that the EO needed to be stopped. While the Trump Administration argued that Judge Coughenour’s ruling went too far, a three-judge panel disagreed and scheduled the case for arguments in June. Nonimmigrant Visa Dropbox Renewal Eligibility Reverts Back to Pre-COVID Standards

Effective immediately, the United States Department of State (“DOS”) has revised the requirements for interview waiver eligibility (commonly referred to as dropbox eligibility) to applicants renewing a nonimmigrant visa in the classification that expired within the past twelve (“12”) months. Previously, some nonimmigrant visa applicants were eligible to renew through dropbox and avoid having an in-person visa interview, if they held an approved visa in any category that had expired within the past 48 months and wanted to renew their visa in the same category.  The DOS expanded 48-month eligibility window was introduced during the COVID-19 pandemic to help reduce consular backlogs.  This was expected to remain in place indefinitely. Now, only those whose prior nonimmigrant visas are the same visa category that expired within the past 12 months remain eligible for dropbox processing.
