What Is Concurrent Filing Of EB–5 Petitions And Applications For Adjustment Of Status?

Concurrent Filing in the EB-5 visa classification, introduced under the EB-5 Reform and Integrity Act of 2022 (“RIA”), allows eligible EB-5 investors already in the U.S. to file Form I-526/I-526E – the immigrant petition by an EB-5 investor – (“EB-5 Petition”) and Form I-485, Application to Register Permanent Residence or Adjust Status (“Application”) simultaneously, streamlining the path to permanent residency. With concurrent filing, eligible investors can submit both forms at the same time, potentially reducing waiting periods and providing immediate benefits, such as work and travel authorization.

To qualify for concurrent filing, an EB-5 investor must:

  • Be physically present pursuant to a lawful entry in the U.S. under a valid nonimmigrant visa (e.g., F-1, H-1B, or L-1).
  • Have a priority date that is current for requisite EB-5 classification according to the U.S. Department of State’s Visa Bulletin.
  • Be legally eligible to change or adjust their status, which means they are not subject to certain immigration restrictions including illegal presence or visa status infractions.

Concurrent filing has a number of important advantages.  Applicants can qualify for advance parole (“AP”) and employment authorization (“EAD”), which permit them to travel abroad and engage in lawful employment while their EB-5 Petition and Application is being processed. Moreover, they do not need to travel outside the U.S. to interview at a U.S. Consulate for an immigrant visa. The process to being granted “conditional” lawful permanent residence can be completed in the United States.

DOS Suspension of Immigrant Visa Processing

On August 21, 2026, the United States Department of State (“DOS”) suspended many immigrant visa processing at Embassies and Consulates worldwide. As a result of the pause, many immigrant visa applicants (including K-1 fiancé visa applicants) have had their  interviews cancelled. Immigrant visa applicants whose cases are currently undergoing processing, including those who were subject to 221(g) administrative review, have also had their cases placed on while DOS is providing additional training to consular officers concerning public charge inadmissibility. Although the suspension is temporary, DOS has not announced a specific date of when immigrant visa interviews and processing will resume.  In addition, the suspension is impacting only applicants who are consular processing at the respective Embassy or Consulate. DOS Releases Fact Sheet On Establishing Birth Tourism Prevention Task Force

The United States Department of State (“DOS”) has released a fact sheet on establishing a new Birth Tourism Prevention Task Force (“Task Force”) that reviews nonimmigrant visa holders activities specifically to identify those who have engaged in birth tourism and to revoke visas for those who engage or facilitate in the practice. The Task Force, which is being overseen by DOS Secretary Marco Rubio, will have a number of functions including the following: According to the Task Force, birth tourism has become a for-profit industry with facilitators marketing the practice as doulas, midwives, or wellness advocates while advertising “birth in the U.S.” services complete with visa coaching and medical arrangements. Regional Center Amendments and Record Keeping

Regional Centers participating in the EB-5 Immigrant Investor program are subject to ongoing compliance requirements designed to maintain transparency and accountability. These requirements include notifying the Department of Homeland Security (“DHS”) of significant organizational changes, maintaining records for a specified period, and cooperating with government audits.
